1. Acceptance of These Terms
By accessing or using the Service, whether as a guest or through a registered account, you agree to these Terms and acknowledge our Privacy Policy.
Where applicable law requires explicit acceptance, PlanSway may ask you to affirmatively accept these Terms.
If you do not agree with these Terms, you should not use the Service.
2. What PlanSway Does
PlanSway is an AI-powered assistant designed to help users discover, evaluate, plan, save, organize, and share real-world experiences.
PlanSway may recommend complete outings ("Plans") that combine activities such as:
- restaurants and bars;
- movies and cinema;
- concerts and live music;
- theater;
- events;
- museums and cultural activities;
- sports, recreation, outdoor activities, and other experiences; and
- related activities such as dinner, drinks, transportation, or other practical steps.
PlanSway is primarily a planning and recommendation service.
Unless expressly stated otherwise, PlanSway does not organize, operate, own, control, or provide the third-party events, venues, restaurants, transportation, attractions, activities, or other experiences that appear in a Plan.
3. Eligibility and Users Under 18
You must be at least 13 years old to use PlanSway.
If you are under the age of majority where you live, you represent that you have any permission or authorization from a parent, guardian, or legal representative that is required under applicable law to use the Service and accept these Terms.
Users under 18 should review these Terms with a parent or legal guardian where appropriate.
PlanSway does not knowingly permit children under 13 to create accounts.
PlanSway's minimum age does not mean that every activity or venue appearing in the Service is appropriate or legally available to every user.
Bars, nightlife venues, alcoholic-beverage providers, events, activities, and other third-party services may impose their own age limits, identification requirements, health requirements, licenses, waivers, or admission conditions.
Users are responsible for verifying and complying with those requirements.
4. Guest Use and Accounts
PlanSway may allow you to use substantial portions of the Service without creating an account.
Guest use may include browsing, requesting recommendations, viewing Plans, and other functionality made available from time to time.
Guest information or saved state may be associated with a device or guest identifier.
Guest Persistence
Guest persistence is provided on a best-effort basis.
PlanSway does not guarantee that guest information, saved Plans, preferences, or other guest state can always be recovered after:
- deleting the application;
- replacing or resetting a device;
- clearing browser or application storage;
- changing devices; or
- other technical events.
Creating or signing into an account is the supported method for more durable account-level persistence.
Registered Accounts
PlanSway may support authentication through methods including:
- email verification;
- Google; and
- Apple.
You are responsible for maintaining the security of your account and authentication methods.
You must not share authentication codes or knowingly allow another person to access your account without authorization.
When a guest creates or accesses an account, certain eligible guest information, including saved Plans, may be associated or merged with the authenticated account.
5. Account Information
You agree to provide information that is accurate and not deliberately misleading.
You may not:
- impersonate another person;
- create an account for fraudulent purposes;
- use another person's credentials without authorization; or
- misrepresent your identity or affiliation where doing so may harm PlanSway, another user, or a third party.
You may request deletion of your account through functionality provided by PlanSway or by contacting support@plansway.com.
Deletion and retention of personal information are also governed by our Privacy Policy and applicable law.
6. Location and City Selection
PlanSway uses location information to help identify relevant cities, places, activities, and Plans.
Depending on your choices and device permissions, the Service may use:
- a city you select manually;
- approximate location;
- precise device location; or
- other location context you provide.
You may browse a city that is different from your physical location.
Granting precise location permission is not required for the current city-level discovery experience where manual city selection is available.
You can modify location permissions through your device or browser settings.
Our collection and use of location information are described further in our Privacy Policy.
7. Plans and Recommendations
A Plan is a suggested or saved outing composed of one or more activities or steps.
Plans may contain information about events, venues, restaurants, attractions, activities, prices, schedules, maps, transportation, reservation requirements, or other practical information.
A Plan is a recommendation or planning aid. It is not a guarantee that any activity, reservation, ticket, venue, product, or service will be available.
Saving a Plan means that you have chosen to keep that Plan in PlanSway.
Saving a Plan does not mean that:
- a reservation has been made;
- a ticket has been purchased;
- a venue has accepted a booking;
- an activity remains available;
- a third party has confirmed anything; or
- PlanSway has entered into a transaction on your behalf.
8. Artificial Intelligence
PlanSway uses artificial intelligence, automated systems, recommendation systems, and external data to help generate and organize Plans.
AI-generated content may be incomplete, outdated, inaccurate, or inappropriate for a particular user's circumstances.
PlanSway attempts to provide useful and reliable recommendations, but it cannot guarantee that AI-generated information is correct.
You should independently verify important information before acting on a recommendation, particularly information involving:
- availability;
- price;
- dates or times;
- opening hours;
- admission requirements;
- age restrictions;
- transportation;
- weather;
- accessibility;
- dietary restrictions or allergens;
- health or physical requirements; and
- safety conditions.
AI recommendations are informational suggestions and are not professional, medical, legal, safety, or emergency advice.
9. Prices, Hours, Availability and Third-Party Information
PlanSway may display or estimate information obtained from PlanSway's systems, third parties, public sources, APIs, partners, or other external sources.
This may include:
- prices;
- menus;
- opening hours;
- event dates and times;
- ticket availability;
- reservation availability;
- ratings;
- reviews;
- addresses;
- travel times;
- images;
- venue status; and
- other information.
We make reasonable efforts to provide useful information, but third-party information can change without notice.
Displayed prices may be estimates and may exclude taxes, fees, service charges, transportation costs, or other charges.
You should verify material information directly with the relevant provider before making a decision or traveling to a venue.
10. Third-Party Providers and External Links
PlanSway may provide links to third-party services, including:
- restaurants;
- ticketing companies;
- reservation services;
- cinemas;
- theaters;
- event organizers;
- transportation services;
- maps;
- activity operators; and
- other external providers.
Following a link may take you outside PlanSway.
Unless PlanSway expressly states otherwise, any transaction you enter into through a third-party provider is between you and that provider, not PlanSway.
The third-party provider is responsible for its own:
- products and services;
- prices;
- availability;
- reservations;
- ticketing;
- cancellation policies;
- refunds;
- admission decisions;
- safety procedures;
- service quality; and
- terms and privacy practices.
PlanSway is not responsible for the acts or omissions of independent third-party providers except to the extent responsibility cannot legally be excluded under applicable law.
11. Reservations, Tickets and Payments
PlanSway currently does not generally sell tickets, make reservations as merchant, or collect payment for third-party experiences.
When PlanSway displays a booking, reservation, ticket, map, website, or similar action, the Service may direct you to an external provider.
Opening an external link does not mean that a reservation or purchase has been completed.
PlanSway may allow you to indicate that you successfully completed an external reservation or purchase. Such a status is informational and does not constitute independent confirmation by PlanSway.
Cancellation, refund, modification, and payment disputes relating to third-party transactions are governed by the applicable provider's terms and applicable law.
Future Direct Services
PlanSway may introduce subscriptions, premium features, booking functionality, or other paid services in the future.
Before PlanSway directly charges users for such services, applicable prices, billing terms, cancellation terms, statutory withdrawal rights, and any additional terms will be presented as required by law.
12. Affiliate Links and Referral Codes
Some external links may contain affiliate identifiers, referral codes, tracking parameters, or similar mechanisms.
PlanSway may receive a commission or other benefit if you follow an affiliate link or complete a transaction with a third-party provider.
Unless expressly stated otherwise, affiliate compensation is paid by the third party.
An affiliate relationship does not guarantee that a provider, venue, product, or experience is suitable for you.
13. Advertising and Sponsored Content
PlanSway may display:
- advertisements;
- sponsored Plans;
- sponsored recommendations;
- promoted venues;
- promoted events; or
- other paid commercial content.
PlanSway may use information about your interests, activity, location, saved Plans, or preferences to personalize advertising or sponsored recommendations as described in our Privacy Policy.
Sponsored or paid content will be identified where appropriate.
Commercial sponsorship does not constitute a guarantee regarding a third party's quality, availability, safety, legality, or suitability.
14. Activities Involving Safety or Physical Risk
Plans may include activities that involve inherent risk.
Examples may include:
- sailing or water activities;
- skydiving;
- motorsports or go-karts;
- hiking or outdoor activities;
- sports;
- nightlife;
- alcohol-related venues;
- travel;
- transportation; and
- other physical or recreational activities.
PlanSway does not operate these third-party activities and does not independently inspect or certify every operator, venue, piece of equipment, instructor, safety procedure, weather condition, or activity.
Before participating, you are responsible for evaluating whether an activity is suitable for you and for reviewing any applicable:
- safety requirements;
- health restrictions;
- age restrictions;
- insurance requirements;
- operator credentials;
- weather conditions;
- waivers; and
- instructions.
Nothing in this section limits rights or responsibilities that cannot be limited under applicable law.
16. User Content
PlanSway may now or in the future allow users to submit content such as:
- reviews;
- comments;
- photos;
- profile information;
- public or shared Plans;
- venue suggestions; or
- other content.
You retain ownership of content you create.
By submitting content to PlanSway, you grant PlanSway a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and technically modify that content as reasonably necessary to:
- operate the Service;
- provide sharing or collaboration features you request;
- maintain and secure the Service; and
- display the content to the audiences you select or otherwise make it available according to the feature being used.
This license does not give PlanSway the right to publicly publish content that the Service represents as private solely because you submitted it.
The license generally ends when the relevant content is deleted, subject to reasonable backup periods, legal obligations, and copies previously shared with other users.
You represent that you have the rights necessary to submit the content you provide.
PlanSway may remove or restrict content that violates these Terms or applicable law.
17. Prohibited Conduct
You may not use PlanSway to:
- violate applicable law;
- commit fraud;
- impersonate another person;
- harass, threaten, exploit, or harm others;
- publish unlawful or infringing content;
- interfere with the operation or security of PlanSway;
- attempt to gain unauthorized access to accounts, systems, or data;
- distribute malware or malicious code;
- bypass security, rate limits, or access controls;
- reverse engineer the Service except where applicable law expressly permits it;
- scrape, crawl, harvest, or systematically extract PlanSway content or data without authorization;
- use automated systems in a manner that imposes unreasonable load on the Service;
- misuse PlanSway APIs or third-party integrations;
- create fraudulent or abusive accounts;
- use the Service to violate another person's intellectual-property, privacy, or other rights; or
- encourage another person to do any of the above.
18. PlanSway Intellectual Property
The Service and its original elements are owned by or licensed to PlanSway.
This includes, as applicable:
- software;
- source code;
- designs;
- interfaces;
- branding;
- logos;
- text;
- recommendation structures;
- Plan formats;
- databases;
- selection and arrangement of content; and
- other PlanSway-created materials.
Subject to these Terms, PlanSway grants you a limited, revocable, non-exclusive, non-transferable right to use the Service for personal and lawful purposes.
Third-party names, logos, images, reviews, information, and other materials remain the property of their respective owners where applicable.
AI-generated Plans or recommendations may contain information that is not unique to you. Using PlanSway does not grant you exclusive ownership over general facts, ideas, recommendations, or third-party information contained in a Plan.
19. Feedback
If you provide suggestions, ideas, feature requests, bug reports, or other feedback about PlanSway, you agree that PlanSway may use that feedback without restriction or compensation to you.
You are not required to submit feedback.
20. Communications
PlanSway may send communications necessary to operate the Service, including:
- account verification;
- security alerts;
- service notices;
- legal notices;
- support communications; and
- important changes to the Service.
These operational communications may be necessary even if you opt out of marketing communications.
PlanSway may also send marketing emails, recommendations, offers, or push notifications where permitted by applicable law.
Where required, marketing communications will provide a method to unsubscribe or opt out.
You may also manage push-notification permissions through your device settings.
21. Privacy
Your use of PlanSway is also subject to the PlanSway Privacy Policy.
The Privacy Policy explains how PlanSway collects, uses, stores, and shares personal information and describes applicable privacy rights.
22. Private Beta
PlanSway is currently offered as a private beta.
Beta software may contain:
- errors;
- incomplete features;
- inaccurate results;
- interruptions;
- changes in functionality; or
- other issues associated with software under active development.
During the beta, PlanSway may add, modify, test, limit, suspend, or remove features.
We do not guarantee uninterrupted availability or that every feature or item of guest data will always be preserved.
Nothing in this section excludes obligations that PlanSway cannot legally exclude.
23. Suspension and Termination
PlanSway may suspend, restrict, limit, or terminate access to the Service when reasonably necessary, including where we believe that:
- these Terms have been violated;
- an account or activity creates a security risk;
- the Service is being abused;
- fraud or unlawful conduct is suspected;
- continued access could harm PlanSway, another person, or a third party;
- we are required to do so by law; or
- the Service or relevant functionality is discontinued.
Where appropriate and legally required, we will provide reasonable notice.
You may stop using PlanSway at any time and may request account deletion.
Sections that by their nature should survive termination, including provisions concerning intellectual property, third-party transactions, liability, disputes, and prior conduct, will continue to apply.
24. Changes or Discontinuation of the Service
PlanSway may modify, add, remove, suspend, or discontinue features or portions of the Service.
This is particularly important during the private beta, when the product is actively evolving.
Where a change materially affects paid services or legal rights, PlanSway will provide any notice required by applicable law.
25. Disclaimers and Responsibility
PlanSway is designed to help users make decisions, but it cannot guarantee the outcome of real-world experiences.
To the maximum extent permitted by applicable law, PlanSway does not guarantee:
- uninterrupted operation;
- that recommendations will meet every preference;
- the accuracy of third-party information;
- that an event will occur;
- that a venue will be open;
- that tickets or reservations will remain available;
- admission to a venue;
- the performance or safety of an independent provider; or
- that a particular Plan will be suitable for every user.
Nothing in these Terms excludes, restricts, or waives any warranty, right, remedy, duty, or liability that cannot lawfully be excluded under applicable consumer or other law.
26. Limitation of Liability
PlanSway is responsible to users to the extent required by applicable law.
PlanSway is not the organizer or provider of independent third-party experiences and is not responsible for acts or omissions of those providers except where applicable law imposes responsibility on PlanSway.
Where and only to the extent permitted by applicable law, PlanSway will not be responsible for losses that are solely caused by:
- inaccurate or changed information supplied by independent third parties;
- a user's failure to verify material third-party conditions;
- unauthorized misuse of the user's account;
- circumstances beyond PlanSway's reasonable control; or
- actions taken directly between the user and an independent third-party provider.
Nothing in this section limits liability for fraud, intentional misconduct, gross negligence where it cannot legally be limited, personal injury where limitation is prohibited, or mandatory consumer rights.
27. Indemnification
To the extent permitted by applicable law, you agree to be responsible for third-party claims, losses, or reasonable costs arising directly from:
- your unlawful use of the Service;
- content you submit that infringes another person's rights;
- fraudulent or malicious conduct; or
- a material violation of these Terms.
This provision does not require a consumer to indemnify PlanSway for PlanSway's own conduct or where such an obligation would be prohibited or unenforceable under applicable law.
28. Consumer Rights
These Terms are not intended to reduce rights granted to consumers by mandatory law.
If a provision of these Terms conflicts with a mandatory consumer-protection rule, the mandatory rule applies.
Nothing in these Terms is intended to waive rights that cannot legally be waived.
If PlanSway introduces paid services directly to consumers, PlanSway will provide any mandatory cancellation, withdrawal, refund, disclosure, and other consumer mechanisms required for those services.
29. Governing Law and Disputes
For the current Argentina private beta, these Terms are governed by the laws of the Argentine Republic, without prejudice to mandatory consumer-protection rules or other laws that may apply to a particular user.
For consumer disputes, jurisdiction will be determined according to mandatory applicable law.
Nothing in these Terms requires a consumer to waive a court, authority, remedy, or jurisdiction that applicable law gives them.
Before initiating a formal dispute, users may contact support@plansway.com so that we can attempt to resolve the issue where appropriate.
30. Changes to These Terms
PlanSway may update these Terms as the Service evolves.
When changes are material, PlanSway will provide reasonable notice through the Service, email, or another appropriate method where required.
The updated Terms will state their effective date.
Continued use after the effective date may constitute acceptance where permitted by law. Where applicable law requires affirmative consent, PlanSway will request it.
31. English and Spanish Versions
These Terms are available in English and Spanish.
Users may switch between the two versions using PlanSway's language controls.
Both versions are intended to communicate the same substantive terms.
If there is any inconsistency between the English and Spanish versions, the Spanish version controls, subject always to mandatory applicable law.
32. Transfer to a Future PlanSway Entity
PlanSway is currently operated by Santiago Javier Russo and has not yet been incorporated.
If a company or other legal entity is formed to operate PlanSway, the operation of the Service and these Terms may be transferred or assigned to that entity where legally permitted.
PlanSway will provide notice where required by applicable law.
33. General Provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.
A failure by PlanSway to enforce a provision does not automatically waive that provision.
Headings are provided for convenience and do not alter the meaning of these Terms.
These Terms, together with the Privacy Policy and any additional terms expressly applicable to a feature, constitute the agreement governing your use of the Service.
